Waiver and Release of Liability Agreement

This Waiver and Release of Liability ("Agreement") is entered into by and between NATURE COASTIN LLC and the undersigned participant ("Participant").

WHEREAS, the Participant desires to engage in fishing activities with the Charter Company, on a fishing vessel, and the Charter Company is willing to allow such participation under the terms and conditions set forth in this Agreement.

1. Assumption of Risk

The Participant understands and acknowledges that fishing and related activities, including but not limited to boating, handling equipment, and swimming, involve inherent risks, dangers, and hazards, which may result in injury, death, or damage to property. These risks include, but are not limited to, rough seas, slippery decks, equipment failure, animal bites, and accidents while boarding or disembarking the vessel. The Participant fully assumes all risks associated with these activities.

2. Release of Liability

The Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, discharges, and holds harmless the Charter Company, its owners, employees, agents, contractors, and affiliates from any and all liability for any and all injuries, death, or damage to property arising from or related to the Participant's participation in any fishing activity, whether caused by the negligence or fault of the Charter Company or otherwise.

3. Indemnification

The Participant agrees to indemnify and hold harmless the Charter Company, its owners, employees, agents, contractors, and affiliates from any claims, actions, damages, or losses (including attorneys' fees) arising out of the Participant’s own actions or omissions while participating in the fishing charter.

4. Health and Fitness

The Participant warrants that they are in good health, physically fit, and capable of participating in the fishing activities. The Participant agrees to inform the Charter Company of any pre-existing medical conditions or concerns that could affect their participation in the charter.

5. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. In the event of any dispute, claim, or action arising from this Agreement, the exclusive venue for such matters shall be in the appropriate courts of Hernando County, Florida.

6. Entire Agreement

This Agreement represents the entire understanding between the Charter Company and the Participant and supersedes any prior oral or written agreements. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

7. Acknowledgment of Understanding

By signing below, the Participant acknowledges that they have read and understood this Waiver and Release of Liability, are aware of the risks involved, and voluntarily agree to its terms.
